248. SEXUAL HARASSMENT
|

It is the policy of the School District of Springfield
Township to maintain a learning and working environment that is
free from sexual harassment.

Sexual harassment may include, but is not limited to the following:
unwelcome sexual advances, requests for sexual favors and/or other
inappropriate verbal or physical conduct of a sexual nature, verbal
harassment or abuse, pressure for sexual activity, repeated remarks
to a person with sexual or demeaning implications, unwelcome touching,
suggesting or demanding sexual involvement accompanied by implied
or explicit threats concerning grades, job status or position
in the organization.
It shall be a violation of this policy for any member of the
district staff or any student to sexually harass another person,
especially when:
- Submission to such conduct is made either explicitly or implicitly
a term or condition of an individual's employment, advancement
or education;
- Submission to or rejection of such conduct by an individual
is used as the basis for academic or employment decisions affecting
that individual;
- Such conduct has the purpose or effect of substantially interfering
with an individual's academic or professional performance or
creating an intimidating, hostile, or offensive employment or
educational environment.

3.Guidelines

Any person who alleges sexual harassment by any staff member
or student in the school district may file a complaint with a
teacher, school nurse, guidance counselor, the school principal,
his/her immediate supervisor or with the Title IX District Compliance
Officer. The superintendent shall protect the confidentiality
of all parties during the investigation, and the filing of a complaint
shall not reflect upon or negatively affect the individual’s
status, grades or employment conditions.
The right to confidentiality for both the complainant and the
accused will be respected, consistent with the school district's
legal obligations. These
include the necessity for the district to investigate allegations
of misconduct and to take corrective action when such misconduct
has occurred.

A substantiated charge against a staff member in the school
district shall subject such staff member to disciplinary action,
including possible suspension, discharge or any other appropriate
disciplinary measure.

A substantiated charge against a student in the school district
shall subject that student to disciplinary action, including possible
suspension or expulsion, consistent with the Student Code of Conduct.

4.Delegation
of Responsibility
|
Administrative and supervisory employees must take prompt and
effective action to stop known or suspected sexual harassment
of students or staff members. The superintendent, when notified
of an allegation, will institute an appropriate investigation
of the reported incident by involving the Title IX Compliance
Officer and the appropriate district or building level administrators.
The superintendent will cooperate with the appropriate authorities,
as necessary.
Employees and students shall be made aware of the existence of
this policy in appropriate ways including references in the various
teacher handbooks, student handbooks and other district publications.
