235. Student Rights/Responsibilities

1.Purpose

This policy sets forth guidelines by which student rights are to be determined consistent with law.

The Board has the authority and responsibility to establish reasonable rules and regulations for the conduct and deportment of students of the district. At the same time, no student shall be deprived of equal treatment and equal access to the educational program, due process, a presumption of innocence, and free expression and association in accordance with these guidelines.

Attendant upon the rights established for each student are certain responsibilities, which include:

    • school attendance,
    • conscientious effort in classroom work and homework,
    • making up any missed work or assignments,
    • conformance to school rules and regulations,
    • sharing with the administration and faculty a responsibility to develop a climate within the school that is conducive to wholesome learning and living,
    • respect for the rights of others,
    • obedience to properly constituted school authority,
    • volunteering information in matters relating to the health, safety and welfare of the school community and the protection of school property,
    • dress and groom to meet standards of safety and health and so as not to cause substantial disruption to the educational processes,
    • assisting  the school staff in operating a safe school for the students enrolled therein,
    • complying with Commonwealth and local laws,
    • exercising proper care when using public facilities and equipment,
    • reporting accurately in student media and
    • compliance with the rules and regulations of the District.

No student shall be required, as a part of any applicable program, to submit to a survey, analysis, or evaluation that reveals information concerning:

  1. political affiliations;
  2. mental and psychological problems potentially embarrassing to the student or his/her family;
  3. sex behavior and attitudes;
  4. illegal, antisocial, self-incriminating and demeaning behavior;
  5. critical appraisals of other individuals with whom respondents have close family relationships;
  6. legally recognized privileged and comparable relationships, such as those of lawyers, physicians, and
  7. income (other than that required by law to determine eligibility for participation in a program or for receiving financial assistance under such program); without the prior written consent of the student, if emancipated or over 18 years of age, or without the prior written consent of the parent for those students under 18 years of age. However, such survey, analysis or evaluation may be conducted on a wholly voluntary basis, provided that the student and his/her parent have been notified of their rights and of their right to inspect all materials related to the above. All instructional material, including teacher's manuals, films, tapes, or other supplementary instructional material to be used shall be available for inspection by the parents or guardians of the children.

    A student who has reached the age of eighteen (18) years possesses the full rights of an adult and may authorize those school matters previously handled by his/her parents.

    Each student who has reached the age of eighteen (18) years shall assume the full responsibility for his/her performance in school, attendance and compliance with school rules and regulations.

    The parents of each student reaching the age of eighteen (18) shall be informed of the rights of their child.
3.Delegation
of Responsibility

The Superintendent shall develop and promulgate administrative procedures consistent with law and Board policy to ensure that student rights under varying conditions are properly described.

Copies of such procedures shall be furnished to the parents of each student.

Such procedures shall be reviewed annually and updated when required.
