218.1. Weapons

1.Purpose

The Board recognizes the importance of a safe school environment to the educational process. Possession or use of weapons in the school environment is a threat to the safety of students and staff. Therefore, the use, possession or transfer of weapons by students on District property is prohibited unless the weapon has been approved by the building principal for possession in conjunction with a lawful, supervised activity or course. For purposes of this policy, District property means on District grounds, at school-sponsored activities or on public conveyances providing transportation to a school or school-sponsored activity.

 

Weapon shall include but not be limited to any knife, cutting instrument, cutting tool, nunchaku stick, brass or metal knuckles, fire arm, shotgun, rifle, bb or pellet gun, look-alike weapon, chemical agent, explosive device, and/or any other tool, instrument or implement capable of inflicting serious bodily injury.

 

A student is in possession of a weapon when the weapon is found on the person of a student; in the student's locker; under the student's control while s/he is on school property; on property being used by the school; or at any school function, activity, or event held away from the school; or while the student is on his/her way to or from school.

Pursuant to Section 1317.2(b) of the Pennsylvania Public School Code, the School District of Spring field Township hereby enacts this policy regarding the discipline and expulsion of any student who is determined to be in possession of any weapon. In the case of an exceptional student, the Superintendent shall take all necessary steps to comply with the Individuals With Disabilities Education Act.

Penalty

Any student who is determined to have brought a weapon onto any school property, any school-sponsored activity, or any public conveyance providing transportation to a school or school sponsored activity shall be subject to discipline as set forth in the School Code and in the Administrative Rule which shall be developed in conjunction with this policy.

Appropriate legal action will be taken against any student who possesses a weapon, or who assists possession in any way. Students possessing any weapon will be reported to the police.

Any weapon possessed on or about a student while on District property in violation of this policy is subject to seizure and/or forfeiture.

The Superintendent will report to the Office for Safe Schools within the Department of Education all incidents relating to acts of violence or possession of an unapproved weapon by any student on school property as required.

The Superintendent shall report on an annual basis all weapons offenses as required by Act 26 of 1995, as amended.

Students and staff shall be informed of the requirements of this policy on an annual basis.

4. Delegation of Responsibility

The Board directs that the Superintendent develop an Administrative Rule to implement this policy, in conjunction with the Student Code of Conduct and Section 1317.2 (b) of the Pennsylvania School Code.
