003. FUNCTIONS
|
1.Legislative

The Board shall exercise its rule-making power
by adopting bylaws and policies for the organization and operation
of the school district.
- Bylaws may be amended at any regular meeting of the Board
by a majority of all the members, provided that at the preceding
regular meeting the amendment shall have been read and discussed
at length. Upon the declaration of an emergency, an amendment
to the bylaws may be adopted at the regular meeting at which
it is first proposed upon the affirmative votes of seven (7)
Board members.
- The formulation and adopting of written policies shall constitute
the basic method by which the Board shall exercise its leadership
in the operation of the school system.
Policies shall be adopted by resolution of the Board, on which
the vote of each member shall be recorded. New policies, amendments,
revisions and repeal of policies shall be presented and discussed
at one regular, interim business or special meeting of the Board
and shall be voted upon at the next regular, interim business
or special meeting of the Board, provided that at least fourteen
(14) days shall intervene between the two meetings.
Upon the declaration of an emergency by seven (7) Board members,
which finding shall be stated in the resolution, a new policy
or an amendment, revisions or repeal of a policy may be presented
and voted upon at the same meeting, except that the determination
of an emergency shall not be required in the event of fire, fold,
or other unforeseen disasters.
While any policy of the Board is subject to review at any time,
it shall be the duty of the Board to review its policies in January
of each even-numbered year.
The Board reserves the right to review and supersede administrative
rules inconsistent with policies established by the Board or contrary
to law.
The adoption, modification, repeal or suspension of a Board procedure
or policy shall be recorded in the minutes of the Board. All current
procedures and policies shall be printed in the Board Policy Manual.

2.Executive

The Board shall exercise its executive power by
the appointment of a district Superintendent who shall enforce
the statute of the Commonwealth, the rules of the State Board
of Education and the policies of the Board of School Directors
of the School District of Springfield Township.
The Superintendent is responsible to the Board for executing
the policies established by the Board.
The Board reserves the right to review and supersede administrative
rules inconsistent with policies established by 11/08/2006

The Superintendent may prepare administrative
rules for the administration of the school district which are
not inconsistent with statutes or regulations of the State Board
and which are dictated by the policies of this Board. Such administrative
rules shall be binding on the employees to promulgation and shall
be binding on the employees of this district and the students
in the schools of this district when issued.
The Superintendent shall be delegated the authority to take necessary
action in circumstances not provided for the Board policy, provided
that such action shall be reported to the Board at the meeting
next following such action.

The Superintendent shall implement a procedure
to inform employees of their responsibilities under the Ethics
Law. This procedure shall be approved by the Board, and the completion
of the implementation reported to the Board.

The Board may assume jurisdiction over controversies
or disputes arising within this school district concerning any
matter over which the Board has authority granted by statute or
where the Board has retained jurisdiction in contract or policies.

In furtherance of its ad judicatory function,
the Board may hold hearings in accordance with law which shall
offer the parties to a dispute, or notice duly given, a fair and
impartial forum for the resolution of the matter.
Beyond the basic requirements of due process, a hearing may vary
in form and content in line with the severity of the consequence
which may flow from it, the difficulty of establishing findings
of fact from conflicting evidence, and the impact of the Board’s
decision on the school district.
